Foreword:

All business relations between Pec Group Srl and Customers are governed exclusively by the following general conditions of sale, excluding any other agreement, unless agreed in writing, placing an order online, implies full acceptance of the following conditions.

Any person acting on behalf of the Client will represent him or her and commit to Pec Group Srl, since the Client himself or herself is directly responsible for the confidential storage and use of his or her personal password.

1. Products, features, prices and availability

• 1.1 Products are not supplied on trial. Our company technicians can provide guidance on the characteristics of various products, only the customer is responsible for the product purchased.
• 1.2 prices All prices of the products displayed and indicated within the website, for which they constitute an offer to the public, are to be understood as suggested list prices for the end user therefore already including VAT. All products are exclusive of shipping charges which will be clearly displayed before the order is finalized, you can quote shipping on the checkout page of the site before purchasing. Prices of products published from time to time cancel and replace previous ones and are subject to actual availability. Shipping charges include handling and packaging charges and postage. Handling costs are fixed, while transportation costs vary depending on the total weight of the shipment. We recommend that you group your items in one order. List prices and discounts may be changed at any time, without notice except for orders already accepted.
  The prices of products on our e-commerce site, may differ from those in our physical store.
• 1.3 Product availability If an order exceeds the existing quantity in the warehouse, Pec Group Srl will notify within 72 hours the lack of availability and the possible wait for the fulfillment of the order; if the customer and / or consumer does not agree to wait the necessary time for delivery, the contract will be considered terminated and Pec Group Srl will provide the immediate reversal of payment.

2. Order – billing.

• 2.1 E-commerce orders can only be placed via the Internet (online). The customer who sends the order via the Internet will receive, at the end of the procedure, a notice confirming that the proposed order has been entered into our information system. Confirmation of order acceptance or order rejection (for accounting, administrative or product shortage reasons) comes later by electronic mail (E-mail). At the conclusion of the contract the order will be stored on our Server. When filling out the First Order there are mandatory fields to be filled out; when you log back into our Site (as a Registered User) you will simply enter your registration email address and Password to view your information and possibly change it. The responsibility for the management of access credentials are exclusively and absolutely the responsibility of the Client who undertakes to immediately notify our Firm of any unauthorized use as well as any other violation of security rules of which he becomes aware. In default the responsibility is always and only of the Customer. In addition, the user agrees at the end of each session to log out of their account with the appropriate command entered on our Site. Our site is subject to detailed access control, and through the log of the same we will be able to demonstrate any behavioral discrepancies of the Client and challenge them.

• 2.2 Invoicing Commercial invoice will be issued when the ordered products are shipped.
• 2.3 Pec Group Srl reserves the right not to accept incomplete orders.

3. Product Availability

• 3.1 Pec Group Srl does not guarantee the certainty of assignment of the goods ordered, until the order itself is accepted and acceptance communicated to the customer.

4. Shipping and delivery

• 4.1 Shipments and Deliveries: Shipments, unless otherwise agreed, will be made by carriers defined by Pec Group Srl and only when the shipping cost is charged in the order. In case of theft/loss confirmed by the carrier, the Pec Group Srl undertakes to send a new product and, if the same should be unavailable and / or out of stock, will propose a different product, but with equivalent characteristics, with the right for the customer not to accept this new product and request the issuance of credit note relating to the product itself. List prices do not include transportation costs. In the event that the carrier is appointed, in any capacity by the customer, PEC Group Srl will not be responsible for the loss and/or damage of the product from the moment of delivery of the goods to the carrier at its warehouses. Delivery to the Customer, unless otherwise agreed upon in writing between the parties, will be made on the street level and during office hours: 8:30 a.m. to 12:30 p.m.; 2 p.m. to 6 p.m., every day, non-holiday, Monday through Friday. Transportation costs will be calculated when the order is filled. Deliveries that make exceptional and ancillary services indispensable (e.g., deliveries to floors, both upper and lower, hydraulic tailgate for grounding bulky packages, etc.) must be strictly agreed upon at the time of the order. Therefore, no dispute about this will be accepted thereafter. Estimated delivery time varies depending on packing time and when the seller receives payment. Pec Group Ltd. is not responsible for any delays in transit during the shipping service.

Transit times may vary, especially during holidays or inclement weather. As a matter of practice Shipments are made uninsured.

5. Risks and properties

• 5.1 Goods are shipped carriage paid and charged to the invoice. In the event that the goods are shipped carriage paid, at the customer’s instruction, the risk shall be deemed to be borne by the customer from the delivery of the goods to the carrier at our warehouses. Upon receipt of the goods, even with undamaged packaging, the customer is required to immediately ascertain the conformity of the goods with the purchase order placed. In particular, it must verify the integrity of the goods and the quantitative and qualitative correspondence with what is stated in the order and accompanying document (DDT/ACCOMPANYING INVOICE). In case of discrepancies or apparent defects, these must be reported under penalty of forfeiture, on the same accompanying document and confirmed, within seven days of delivery of the goods, by mail to info@pecgroupsrl.com or registered mail A.R., to Pec Group Srl Via G. Garibaldi 9 37050 Villafontana di Oppeano VR. Any report made after this deadline or in a different manner will not be considered. The client will be liable for any damages resulting from reports and misrepresentations.

6. Payments

Products ordered by the Customer will be kept committed until proof of transfer is received and sent to amministrazione@pecgroupsrl.com no later than 3 working days from the date of order acceptance. The shipment of what has been ordered will take place only when the actual crediting of the amount due on the account of Pec Group Srl, which must take place within 7 working days from the date of acceptance of the order. Beyond these deadlines, the order will be deemed automatically cancelled.

• 6.2 PAYMENT BY BANK TRANSFER

The reason for the bank transfer should state:

• the order reference number;
• First and last name of the order holder. For each order placed Pec Group Srl will issue an electronic invoice for the material shipped, sending it through the portal of the Internal Revenue Agency to the order holder. For the issuance of the invoice, the information provided by the Customer at the time of the order shall be binding. No changes in the invoice will be possible, after it has been issued. Payments can be made in the forms stipulated in the program. If payments are made by Credit Card, the transaction will automatically be moved, for security reasons, to the Site
  Of the credit institution. Bank details for transfers will be communicated by e-mail, and goods will be shipped only when we are in possession of the payment.

7. Right of Withdrawal

The right of withdrawal is regulated under the law if the customer-consumer (i.e. a natural person who purchases goods for purposes not related to his professional activity, i.e., does not make the purchase by indicating in the order form a VAT number reference) has the right to withdraw from the purchase contract for any reason. To exercise this right, the customer must send Pec Group Srl a notice within 10 days working days from the date of delivery of the goods. Such notice should be sent by registered letter with return receipt to our office or by Pec to pecgroupsrl@legalmail.com
Please note: Customers who purchase with an invoice using a VAT number(Company/VAT number) cannot exercise the right of withdrawal because the purchase of the product is part of the professional activity, and the withdrawal regulations only apply to Consumers.

7.1 Methods of Withdrawal   The right of withdrawal is still subject to the following conditions:

• The return of the goods is the responsibility of the customer and the shipment, until the certificate of receipt in our warehouse, is under the full responsibility of the customer; Our Company is not liable in any way for damage or theft/loss of goods returned with shipments paid by the customer.
• The purchased goods must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment); to limit damage to the original packaging, we recommend, when possible, to put it in a second box. Attach a label to the box with the following address PEC GROUP SRL Via Giuseppe Garibaldi, 9 – 37050 Villafontana di Oppeano (VR). Affixing labels or adhesive tapes directly onto the original product packaging should be avoided in all cases;

When the right of withdrawal lapses

The right of withdrawal lapses totally, for lack of the essential condition of integrity of the good (packaging and / or its contents), in cases where Pec Group Srl ascertains:

• Even partial use of the asset and any consumables
• The lack of the original outer packaging and/or inner packaging;
• The absence of integral elements of the product;
• Damage to the product due to causes other than its transportation
• In the above cases, Pec Group Srl will return the purchased goods to the sender, charging the sender for the shipping costs
• Customers who purchase with VAT number cannot exercise the right of withdrawal

8. Goods Returns

8.1 Return requests for obvious product anomalies or discrepancies must be received in writing within 7 days of receipt of the goods by writing to info@pecgroupsrl.com. 

8.2 Mode of re-entry:

• The goods must be returned, within 7 (seven) days, to the address of our operating headquarters in the manner specified by Pec Group Srl
• Products must arrive in their original packaging and in any case must be saleable: if this is not the case, we reserve the right to return the material to the customer at the cost of reshipment, suspending the sending of the replacement or partial credit and, in any case we will charge the costs we incurred in restoring the material.
• The cost of transportation will be borne by us with our own courier in case the error is attributable to PEC GROUP Srl. In all other cases it will be the responsibility of the Client.
• In the event of a price list change, the amount credited will be the amount that is best for Pec Group Srl.

8.3 Complaints: Any shipping errors or material shortages must be reported, in writing, in the manner and within the time limits specified in Section 8.

9. Guarantees

The purchase of material from Pec Group Srl, implies full acceptance of the warranty conditions provided by Pec at the time of order confirmation.

BUYER’S OBLIGATIONS

It is forbidden for the buyer to enter false and/or fictitious data in the registration procedure necessary to activate the process for the execution of this contract and further related communications; the personal data and e-mails must be exclusively his own real personal data and not of third persons or fictitious.
The Client releases Pec Group Srl from any liability arising from the issuance of erroneous tax documents due to errors related to the data provided by the Client, the Client being solely responsible for their correct entry. The customer agrees, once the online purchase procedure is completed, to print and keep these general conditions, which he/she will have already viewed and accepted as an obligatory step in the purchase, and to print the specifications of the product being purchased.
The guarantee of the successful completion of the payment that the customer makes by the means indicated above, has an essential character, so that by express agreement the customer’s failure to comply with this obligation will result in the legal termination of the contract without the need for judicial pronouncement, without prejudice to the right of Pec Group Srl to take legal action for compensation for further damage.

CONTRACTUAL TERMINATION AND EXPRESS TERMINATION CLAUSE

Pec Group Srl has the right to terminate the contract entered into by giving simple notice to the consumer and/or customer with adequate and justified reasons; in this case the customer will be entitled only to the refund of any amount already paid. We would like to remind our customers that product images and features may be subject to changes that are beyond our control; if you have any questions or information about the products in our shop, please contact us before making your purchase.

Processing of Personal Data:

Pursuant to Law no. 196/03, the customer acknowledges that the “personal data” communicated and/or exchanged, even during pre-contractual information, will be processed pursuant to, for the effects and with the purposes of art. 12, para. 1, paras. b), c), d) and f) of Law No. 196/03 as amended and supplemented.
It is further understood that the customer expressly consents to the transfer of “personal data” in accordance with Art. 28 paragraph 4 letter a) of Law No. 196/03 and, in any case, to their communication and dissemination pursuant to and for the purposes of Art. 20 Paragraph 1 (a) of the said law.

10. Disputes

The Court of Verona will have jurisdiction for any disputes that may arise.

11. Conditions

The conditions contained herein may be changed, without prior notice and shall be valid from the date of publication on our website, without prejudice to orders already accepted.

By signing for approval the above clauses on the occasion of the first order following the publication on the Internet of the preceding general conditions of sale, the user declares that he/she gives his/her approval of them-if they remain unchanged- for subsequent orders as well, unless he/she specifically notifies otherwise to
